BIOETHICAL ASPECTS OF HUMAN DIGNITY AND FEATURES OF THEIR LEGAL CONFIRMATION IN FOREIGN CONSTITUTIONS

Abstract
Background. The phenomenon of human dignity in bioethics is becoming the most relevant research goal for various states, the legal confirmation of which is necessary for developing a new stage of the concept of human rights. The research focuses on exploring the features of legal confirmation of certain bioethical aspects of human dignity in the constitutional acts of various states. Materials and methods. The article examines the works of researchers who reckon that human dignity is the core value of human rights and that respect for dignity guarantees the indivisibility of rights. It provides a legal analysis of the constitutional norms in various states that enshrine the right to bioethics. The author performs a comparative analysis of the constitutional norms in various European and Asian states, as well as conducts a historical analysis of the norms of constitutional law in foreign states through the prism of the entry into force of international legal norms that enshrine human rights in general and dignity right in particular. Results. The research concludes that most foreign constitutions have general norms containing certain aspects of bioethical dignity of an individual; the historical analysis shows the evolution of the confirmation of such rights both at the international level and at the national level for an increasing number of states. The author agrees with the views of leading researchers that human dignity has been and remains the core value of human rights and that respect for dignity ensures the indivisibility of human rights. Conclusions. Depending on the features of national development, most foreign constitutions contain general norms covering the certain aspects of bioethical dignity of an individual.
